These Terms of Service ("Terms") govern your access to and use of the Website and all services, features, and content offered through it (collectively, the "Service"). By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

DigiBouquet AI is a browser-based digital flower gift tool with two creation paths. The Service allows users to:

  • Create Free Bouquet — assemble flowers, greenery, and card styles step by step without an account
  • Create AI Bouquet — generate an arrangement from a short prompt (requires sign-in and credits or a subscription)
  • Choose card templates, backgrounds, and visual styles for their arrangement
  • Personalize bouquets with recipient names, sender names, and free-form messages
  • Share a unique link, download an image, or view bouquets opened via shared links

Free assemble encodes bouquet configuration in the shareable URL for many classic builder flows. AI Bouquet generation and account features may involve server-side processing, authentication, and credit or subscription billing as described on Pricing. We may store account and generation-related data needed to provide those features.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

3. Acceptable Use

By using the Service, you agree to use it only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Service. You agree not to:

  • Use the Service to transmit, distribute, or store content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
  • Use the Service to create bouquets with messages that constitute hate speech, discrimination, or harassment based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
  • Attempt to gain unauthorized access to any portion of the Service, its related systems, or networks connected to the Service
  • Use automated scripts, bots, scrapers, or other automated means to access the Service in a manner that exceeds reasonable personal use
  • Attempt to interfere with or disrupt the integrity or performance of the Service or the data contained therein
  • Remove, alter, or obscure any copyright, trademark, or other proprietary notices from any portion of the Service
  • Use the Service in any manner that could damage, disable, overburden, or impair the Service or servers or networks connected to the Service
  • Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the Service (except to the extent permitted by applicable law)
  • Use the Service to send unsolicited communications (spam) to others
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity

We reserve the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these acceptable use provisions, including suspending or terminating their access to the Service.

4. Intellectual Property

The Service, including its site design, layout, user interface, code, graphics, flower visuals, petal effects, greenery visuals, and bouquet arrangement designs, is part of DigiBouquet AI and is protected by applicable intellectual property and unfair-competition laws.

The flower, petal, greenery, and bouquet arrangement visuals presented through DigiBouquet AI are proprietary DigiBouquet AI service assets provided for use within the Service. You may use them to create and share bouquets through DigiBouquet AI, but you may not take them for separate use outside the Service without prior written permission.

The DigiBouquet AI name, logo, site copy, and product presentation remain proprietary to DigiBouquet AI. You may not copy, adapt, or reuse them in a way that suggests affiliation, republishes the service experience, or removes the usage boundaries stated on this site.

  • download, extract, or archive the visual assets for separate use outside DigiBouquet AI
  • redistribute, repost, resell, or publish the visuals or bouquet arrangement designs outside DigiBouquet AI
  • use the visuals or bouquet arrangement designs in commercial work, datasets, or AI training workflows
  • remove, alter, or bypass any copyright, attribution, or usage notice displayed by DigiBouquet AI

User Content: You retain ownership of the text content (names, messages, and prompts) you create through the Service. By using the Service, you grant DigiBouquet AI a non-exclusive, worldwide, royalty-free license to process this content as needed to generate shareable bouquet links, images, and AI Bouquet outputs. We do not sell your personal messages.

Open Source Components: The Service may incorporate open-source software components governed by their own licenses. Nothing in these Terms limits your rights under, or grants you rights that supersede, the applicable open-source license terms.

5. User-Generated Content

The Service allows you to input text content including recipient names, sender names, personal messages, and AI prompts ("User Content"). For many free-assemble shares, User Content is encoded in the shareable URL. For AI Bouquet and account features, prompts and related data may be transmitted to and processed by our systems (and providers we use) to generate results. You bear sole responsibility for all User Content you create and share through the Service.

By creating User Content through the Service, you represent and warrant that:

  • You have all necessary rights, licenses, consents, and permissions to create and share the User Content
  • Your User Content does not violate any third party's intellectual property rights, privacy rights, publicity rights, or other legal rights
  • Your User Content does not contain any viruses, malware, or other harmful code
  • Your User Content complies with all applicable laws and regulations

You acknowledge that once you share a bouquet link, the User Content encoded within it (including names and messages) is accessible to anyone who receives and opens the link. You are solely responsible for deciding with whom you share your bouquet links and for any consequences that arise from sharing such content.

We do not monitor, review, or screen User Content created through the Service. However, we reserve the right to investigate any reported misuse of the Service and take appropriate action in accordance with these Terms.

6. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect information in connection with the Service. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

As noted above, DigiBouquet AI does not treat free-assemble card text as a permanent message vault in the classic URL-share flow. AI Bouquet prompts and account activity may be processed to deliver generation and billing. We also use third-party services (such as Google Analytics and Google AdSense) for anonymized usage data and advertising. Please review our Privacy Policy for complete details.

7. Disclaimers and Limitation of Liability

Disclaimer of Warranties: THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DIGIBOUQUET AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that (a) the Service will function uninterrupted, securely, or be available at any particular time or location; (b) any errors or defects will be corrected; (c) the Service is free of viruses or other harmful components; or (d) the results of using the Service will meet your requirements or expectations.

  • Any content obtained from the Service

IN JURISDICTIONS WHERE THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES IS NOT ALLOWED, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. EXCEPT WHERE A SEPARATE PAID PLAN OR CREDITS AGREEMENT SETS A DIFFERENT CAP, OUR MAXIMUM AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF ONE U.S. DOLLAR (USD $1.00) OR THE AMOUNTS YOU PAID TO DIGIBOUQUET AI FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages, so the above limitations may not apply to you in their entirety.

  • Google Fonts — We load fonts (Quicksand and Dancing Script) from Google Fonts. Your browser may send requests to Google's servers when loading these fonts. Google's Privacy Policy applies to any data Google collects from these requests.
  • Google Analytics — We use Google Analytics to understand how users interact with our website. This involves the collection of anonymized usage data including page views, session duration, and general geographic region.
